A public commenter told the San Jacinto County commissioners that an Attorney General opinion dated October 2024 and the state open-meetings statute require clearer notice about the subject matter of executive sessions and that public comment should occur before formal action is taken.
The commenter said the opinion interprets Local Government Code section 551.041 as requiring that agendas identify the subject matter for executive sessions rather than using boilerplate language, and argued the current agenda wording could prevent the public from getting adequate notice. "The public is supposed to be able to comment on things before y'all act on them," the commenter said during a prolonged public-comment period.
The remarks pressed county officials to add more precise descriptions to agenda items, especially when the agenda describes "adding material to an existing road" or similar technical actions people may not immediately understand. The commenter said the present wording is confusing and recommended the county provide explicit subject-matter descriptions so residents know when to speak on an item.
County officials did not record a formal vote in the transcript on changes to public-comment scheduling at the time of the remarks. Commissioners and staff were present during the exchange, and subsequent agenda discussion addressed related phrases in the county's construction and inspection language.
