"Council member Bob Nunningamp asked to recuse himself from the vote concerning the easement litigation…Mr. Nunningamp was not permitted to recuse himself," Vandenberg said, adding that plaintiffs in the litigation had told council they intended to add Mr. Nunningamp personally to the suit. She said Nunningamp was not on council at the time of the events underlying the case and could face personal legal expenses for matters he did not participate in.
Vandenberg said that council announced a proposed settlement after a closed session but provided no settlement details in open session and that she does not know how individual council members voted. She questioned whether the possibility of personal legal exposure influenced deliberations in open session and whether other council members received similar communications from the plaintiffs. "We do not know yet the settlement details," she said, and added she has already requested related records from the mayor, council and village attorney.
