City staff explained the primary early‑termination condition is the city establishing a south‑end fire station in the UGA staffed with full‑time personnel year‑round and certified by a third party as meeting staffing criteria. Financial terms spelled out in the presentation include a $750,000 payment by the city due in 2027; if early‑termination conditions are not met the agreement contemplates quarterly evaluations that could increase city obligations in later years. The districts will also transfer certain assets to the city under a schedule that includes payments to the city in 2028 (District 6: $250,000; District 5: $225,000) as described in staff comments.
Council moved to suspend rules requiring two readings of the financial resolution and then moved to approve and ratify the settlement and adopt the annexation mitigation resolution. The motion passed with a majority 'Aye' vote; one councilor recorded a 'no' vote stating the matter was financial and should have gone through two readings even though he agreed with its contents.
Next steps: staff will execute the annexation mitigation agreements and monitor the early‑termination benchmarks described in the settlement; the city will also schedule any future financial evaluations required under the agreement.
