The Midway Board of Adjustment voted to approve a conditional use permit for a short-term rental at 425 Buck Run Road after hearing from staff and the applicant.
Staff member Steve told the board the application, filed May 5, 2026, seeks to operate a short-term rental in a CO-1 conservation zone and cited the zoning ordinance provisions that make short-term rentals conditionally permissible in the conservation district. He outlined the applicant’s proposed conditions: a 10-guest occupancy limit, on-site garage and driveway parking, on-site local management and address, basic safety compliance (smoke and carbon-monoxide detectors and fire extinguishers) and trash management.
Applicant Courtney Choir said the house at 425 is riverfront and that she and her family have been restoring the property after flood damage. “We were hoping after that to do a short-term rental to try to make up some of the money we’ve spent restoring it,” Choir said, adding that the family intends to use the house for family stays in summer months before renting seasonally. She confirmed smoke and carbon-monoxide detectors and fire extinguishers are already in place and agreed to quiet hours.
Board members asked about timing and neighborhood impacts; the recorded conditions included a 10:00 p.m.–8:00 a.m. quiet-hours restriction and a prohibition on amplified music to address noise concerns. After closing public comment, a member moved to approve the permit subject to the applicant’s and board’s agreed conditions. The motion was seconded and approved by voice vote.
The permit approval includes the operational conditions read into the record: 10-person maximum occupancy, on-site parking, local management contact, standard safety-device compliance and trash control, plus the quiet-hours and no-amplified-music requirements. The board noted staff will finalize the exact wording of conditions in the permit documentation.
