Daniel council delays Daniels Highway 40 Storage license over buffer-zone dispute, approves new home-staging license

The Daniel Town Council on May 4 approved a new business license for Moxy Home Services LLC (doing business as Showhomes Summitt) and renewed multiple existing licenses, but it paused approval of Daniels Highway 40 Storage pending clarification of a recorded buffer zone on the property.
Lindsay Simpson, representing Moxy Home Services, said her firm provides interior-home staging to homeowners and realtors and operates without a retail storefront. Councilmember Eric Bennett moved to approve the new license and the council voted unanimously to grant it.
Town Planner Eric Bunker told the council he had received complaints alleging Daniels Highway 40 Storage was using a recorded buffer zone for operations. The recorded agreement and map, he said, show the front 50% of the parcel approved for commercial use while the rear portion is designated as a buffer. Managing partner Mark Haroldsen said he had been told the buffer could not be developed but was not told it could not be used operationally; he said the business has one boat parked in the buffer and that he would be open to neighbors using the space for agricultural purposes.
Councilmembers pressed for a clear delineation of the buffer zone and expressed concern about preserving the lifestyle of neighboring residents. Councilmember Gary Walton said the buffer zone "was not meant to be an extension of the storage space." Councilmember Eric Bennett said the council’s priority is protecting neighbors rather than maximizing sales tax revenue. Mayor Scott Kohler asked Haroldsen to define the buffer zone and meet with the Town Review Committee; the council voted to continue the Daniels Highway 40 Storage license decision until the buffer-zone boundary and permitted uses are clarified.
The council also unanimously renewed licenses for Bart Wilde & Associates, Jolley Electric, Norwood Construction, Rafter K Construction, Given’s Gravel & Dumping Services, and Daniels Creek Construction. No formal enforcement action was taken at the meeting; the council requested that the property owner work with staff to resolve the boundary question.
