Planning commission flags legal-services overrun, pauses outside-counsel assignments

The Oxford Planning & Zoning Commission approved several routine legal invoices but recorded concern that its legal-services budget is significantly overdrawn and agreed not to authorize additional outside work without prior approval from the chair and coordination with the selectmen's office.

The commission approved invoices from outside counsel for routine work and then considered an invoice from the Sherin Law Office for $4,180 covering 22 hours of services. A commissioner stated on the record that the legal-services line item is “way... over” its budgeted amount and asked that any further invoices be held until the commission develops an appropriation plan. The commission discussed taking a transfer from the board of finance contingency or other selectmen-controlled funds to cover the shortfall.

Commissioners directed staff and the chair to coordinate with the selectmen’s office and the board of finance before authorizing further outside counsel work. The chair also instructed that, except for previously approved matters, the commission should not engage additional attorneys without explicit authorization. Members noted pending court matters tied to Roosevelt Drive and Donathan Road and that motions have been filed by opposing parties; commissioners emphasized caution about hiring duplicate representation while a case is active because it can double costs.

The commission also heard that certain applicant fees (a cited estimate for one Roosevelt Drive excavation fee of roughly $20,000–$25,000) may offset some legal costs, but commissioners stressed that the amount and timing of those fees were not certain and must not be assumed as guaranteed revenue. No formal budget transfer was approved at the meeting; commissioners agreed to pursue an appropriation or transfer through the selectmen’s and finance offices.
