Budget analyst Diana told the commission the Civil Service Commission will run a request for proposals to recruit hearing officers; the commission has not run a call for applicants since 2015. She said the RFP will be open for three weeks, applicants will submit qualifications and hourly rates, and staff will run background investigations before compiling a list for commissioner review.
Diana cited governing authorities: Charter section 9.3.7 (retention of hearing officers) and Civil Service Commission Rule 14 (qualifications). "Charter outlines that we need to have at least three hearing officers ... the commission will compile the list of names ... give that list to the manager of safety and the representatives for firefighters and police; they'll then strike names off of that list and rank the order," Diana said.
She described the five qualification pathways in Rule 14: past service as an administrative law judge/hearing officer/arbitrator within recent years; experience practicing law (with labor/employee relations comprising a portion of practice); five years as a sitting judge in specified courts; current contracted hearing officers for the commission; or a discretionary fifth category of "quality, length and level of experience" approved unanimously by the commission.
Commissioners asked about pay and market rates; staff said applicants will propose hourly rates in their bids and that internal market-rate research informed budget projections but the RFP will not set a fixed maximum rate. No contract awards were made at the meeting; staff indicated the timeline includes a 15-day review by the manager of safety and bargaining representatives after the commission compiles its list.
