Commissioners continue sign-off on Brown development agreement to clarify fence, right-of-way and deed timing

Valley County commissioners on June 1 continued review of CU25-033, the Brown development agreement for property on Lumis Lane, asking staff and the applicant to clarify technical language before the board signs the final document.

The development agreement outlines shared vehicle access points, restrictions on direct vehicular access to Highway 55, parking and storage limitations, a one-year review requirement and a $2,000 contribution toward a potential turn lane warrant. The agreement also requires a right-of-way dedication measured from the center line of Lumis Lane and tree screening along Highway 55.

Applicants asked the board to clarify temporary encroachment by an existing fence (the fence sits at 35 feet from the center line while the final dedication calls for 50 feet). Commissioners requested language explaining that the fence may remain temporarily until road widening requires its removal and that the right-of-way dedication deed must be completed and recorded on or before Dec. 31.

Staff agreed to revise the agreement and return the matter for signatures at the June 8 meeting. Commissioners emphasized that any intensification or material modification of the use would require further review and that deed and survey documents will be needed to effect the right-of-way dedication.

The board did not take a final approval vote on the amended agreement at the June 1 meeting and set a short agenda item on June 8 for signatures after staff incorporates clarifying edits.
