Westside legal counsel says district will revert to 2020 Title IX rules after federal court vacatur

Legal counsel told the Westside Community Schools Board of Education on Feb. 3 that a U.S. District Court in Kentucky has vacated the Department of Education’s 2024 Title IX regulatory revisions.
Nick Lesiak, the district’s in-house legal counsel, said the district originally adopted the 2024 revisions in September 2024 but will now return to the 2020 Title IX regulations the district had in place. Lesiak said he will present policy #2214 for board approval at the Feb. 18, 2025 meeting.
Lesiak noted the federal court ruling and the change in the Department of Education administration as background for the board’s next steps. The board did not take a public vote on the policy at the Feb. 3 meeting; Lesiak framed the discussion as a procedural update and scheduled a formal vote for the subsequent meeting.
The minutes state that the district’s policy documents and the 2020 version of Policy #2214 are included in the board documents folder for review.
The board will consider Policy #2214 at its Feb. 18 meeting; no final policy action was taken Feb. 3.
