Town staff and legal counsel discussed that Utah law contains limited agricultural exemptions for certain small burns on cultivated lands; staff said referencing the state code directly simplifies enforcement because state code preempts local law in those cases.
The council conducted a roll-call vote and recorded unanimous approval. The ordinance is intended as an educational and enforcement tool: staff said they will educate residents, add signage and refer to state code for penalty details if violations occur.
For enforcement and penalties, staff referenced Utah State Code section 65A-8-211 (state fire-code provisions and exemptions) and noted penalties vary depending on conditions such as red-flag warnings.
