Commission grants negative determination for 166 Main and 3 Balch Ave after discussion of buffer work

The Groveland Conservation Commission on May 13 voted to issue a negative determination of applicability for work at 166 Main Street and 3 Balch Ave. The applicant’s plans show the proposed two‑family houses largely outside the 100‑foot wetland buffer, with approximately 1,130 square feet of grading inside the buffer for yard work and grading that the engineer said cannot be avoided.
During discussion the commission asked that erosion controls (straw wattles) be installed, that proposed dry wells and infiltration measures be kept outside the 100‑foot buffer, and that the applicant address existing open orders from a 2005–06 filing (the applicant indicated he would locate the recorded order and prepare an as‑built/COC request to close the old file). Commissioners also raised concern about knotweed on site and asked the applicant to employ measures to avoid spreading invasive species when operating equipment.
Committee member (S4) moved for a negative determination and the motion was seconded; the chair declared the motion approved unanimously. The commission directed staff to issue the MassDEP form and a letter summarizing the decision and to follow up on the prior order closure.
Next steps: staff to issue the negative determination paperwork and a letter to the applicant and to report back on the status of the older order and required monumentation and plantings.
