The Village of Montgomery board approved a conditional site-plan resolution for the KSH commercial project after a presentation by the applicant and discussion of mitigation measures. The applicant (Presenter, S13) said the project traces to 2018 and that the current plan includes two 80,000-square-foot buildings with sound- and aquifer-mitigation provisions and a conservation easement for undeveloped land.
"All of the sound mitigation and the aquifer mitigation have been incorporated into the plan and have been incorporated into the conditional site plan approval motion," the presenter said, noting the planning board's independent consultant reviews of hydrology and noise. The presenter said the conditional site-plan approval motion, adopted in April 2026, captured the conditions required by the planning board.
A planning-board representative (S21) said the project underwent extensive review, including consultant assessments and two public hearings, and listed about 25 specific mitigation conditions the applicant agreed to perform. The representative recommended the trustees rely on the multi-year review and the consultants' findings.
Trustee (S2) said the approval should prompt a review of the village comprehensive plan and zoning to make sure code and community vision align going forward. "This should serve as a call to really look at our comprehensive plan and immediately make sure that our zoning and planning work are aligned with what we've adopted as community members," she said.
The board moved, seconded and took a roll call during which at least one member recorded an abstention on the record. The chair announced the motion carried; the full roll-call details were not consistently recorded in the transcript.
Next steps: trustees asked staff to follow up on comprehensive-plan alignment and to ensure clear delineation of the conservation easement and the proposed on-site liaison role discussed by residents and the planning board.
