Danbury planners recommend against allowing rental/lease vehicle deliveries as a permitted use in IL‑40

The Danbury Planning Commission on June 5 voted to send a negative referral to the zoning commission on a proposed text amendment that would add a permitted use described as a "business or professional office for delivery of rental and/or leased automobiles and trucks" to the IL‑40 zoning district.
Planning Director Jennifer read a detailed staff analysis saying the proposed language duplicates uses already regulated elsewhere in the code, lacks the specific use regulations that limit auto sales and rentals in other districts, and could permit a peripheral proliferation of retail activity in industrial areas. "This proposed petition effectively swings the door wide open to additional commercial uses in retail sales," Jennifer said, warning the change would blur the line between industrial and retail uses.
Commissioners echoed staff concerns about ambiguity and the effect on the industrial nature of the IL‑40 district. The chair said he could not "get his arms around" what problem the amendment solved or how it would improve clarity in the zoning code. Given those concerns, a motion for a negative referral — citing duplication, ambiguity and inconsistency with the Plan of Conservation and Development — carried by voice vote.
The zoning commission is scheduled to hold a public hearing on the petition on June 11, 2024, where members of the public and applicants may present additional testimony.
