Planning board approves Autumn Sky Plaza cannabis dispensary with landscaping, lighting conditions

The Town of Newburgh Planning Board on May 21 approved an amended site plan and special-use permit for The Leaf New York LLC to operate a state-licensed adult-use cannabis dispensary at 254 Route 17K in the IB zoning district. The vote was unanimous.
Applicant Joseph Minuta told the board the project involves changing two existing retail suites into a dispensary with no exterior alterations to the building. He said perimeter pole lights are 5,000 kelvin LED fixtures that are not switchable and that building-mounted fixtures vary in color temperature; the applicant offered to make building fixtures consistent with the pole lights or to match a kelvin level the board prefers. "The pole lights are 5,000 and the building lights vary — we can make those consistent," Minuta said.
Why it matters: the project requires a special-use permit under Town Code 185-48.9 and a state license from the New York Office of Cannabis Management (OCM). MHE Engineering staff reported the application had been sent to the county for review and that the project qualifies as a Type II action under SEQRA, meaning no further SEQRA action was required.
The board’s approval is conditioned on submission of final landscaping plans and lighting details consistent with the board’s direction, compliance with any Zoning Board of Appeals variances, and provision of a current Certificate of Licensure from the New York Office of Cannabis Management. Board attorney James Lindeman said the certificate requirement will be written into the resolution with a provision that the special-use permit would automatically be revoked if the OCM license lapses or is revoked or if ownership changes without board review.
There were no public speakers during the hearing. MHE’s Pat Hines told the board he believed the panel could approve the application that night with any conditions it deemed necessary. After motions to close the public hearing and to approve the conditions, the board recorded seven yes votes and carried the motion.
What’s next: The applicant must file the landscaping and lighting plans and provide the OCM Certificate of Licensure. If the license expires or is revoked, the special-use permit will be subject to automatic revocation and any new owner must return to the board for a new permit.
