The Seabrook Board of Adjustment on June 26 ratified a Consent Decree resolving RMH NH LLC v. Town of Seabrook (HAB Case No. ZBA 2022-26) that would authorize construction of up to 230 multifamily units and 17 duplexes at 319 Route 107, subject to Planning Board approval and other conditions.
Jeff Brown, chair of the Board of Adjustment, read the proposed Consent Decree aloud and provided copies to members of the public. Brown told attendees the agreement increases the town’s workforce housing commitment under the settlement. The public rehearing attracted several abutters and nearby residents who voiced concerns or opposition to the proposed development.
Named abutters who spoke during the public comment period included Brian Halloran (13 Maple Ridge Road), Chad Reardon (26 Deer Crossing Road), Cherise Burke (96 Maple Ridge Road), John Hird (Irenes Way), Laurie Reardon (26 Deer Crossing), Sheila Halloran (13 Maple Ridge Road), Joe Connolly (70 Maple Ridge Road), Kathy Mackay (27 Maple Ridge Road), Theodore Panolpoulos (Irenes Way), Phil Walsh (31 Irenes Way) and Matt Serbon (170 Cimarron Drive). Several speakers objected to aspects of the proposal; one attendee, Cherise Burke, was recorded as “very upset.”
After public comment the board voted on a motion to ratify the Consent Decree. The motion, made by David Davidson and seconded by Jim Sanborn, passed 4–1: Jeff Brown (Yes), James Sanborn (Yes), Teresa Thurlow (Yes), David Davidson (Yes) and Fidea (spelled Fidae in later notes) Azouri (No). The transcript records the dissenting vote by Azouri but does not include a substantive floor explanation from the dissent in the segments provided.
The Consent Decree, as described in the rehearing, conditions the project on subsequent Planning Board approvals and additional terms; the decree is to be filed with the New Hampshire Housing Appeals Board. The board’s recorded ratification completes the ZBA step in the HAB case; next steps include any Planning Board review and compliance with the conditions listed in the Consent Decree.
