The Seabrook Board of Adjustment on July 24 granted a dimensional variance to David and Deborah Dwyer to construct a family accessory dwelling unit (ADU) 7.5 feet from a lot line in Zone 2R where the ordinance requires a 10-foot setback. The applicants said the ADU is for family members moving into the home; Henry Boyd of Millenium represented the Dwyers during the hearing.
After reviewing the petition and hearing evidence, the board recorded that the five statutory variance criteria were satisfied. The transcript records five members (Fidea Azouri, Phil Howshan, Dave Davidson, Teresa Thurlow and Jim Sanborn) voting “yes” on each of the five criteria; the board moved to grant the variance as presented. The motion to grant was made by Dave Davidson and seconded by Phil Howshan.
The board’s notice of decision reiterates the condition that any variance granted must be completed within two years or the relief expires and that compliance with conditions is required before a building permit can be issued. No monetary amounts or construction schedules were specified at the meeting.
The variance allows the Dwyers to proceed with permitting steps subject to conditions in the written decision.
