The Seabrook Board of Adjustment on July 24 approved an equitable waiver allowing Caitlin Realty to place a newly constructed building 20 feet from the Zone 2R wetland boundary, less than the 25-foot setback required by Section 7 of the town zoning ordinance. Henry Boyd of Millenium represented the applicant and explained the request, saying the current lot configuration and earlier changes to flagged trees contributed to the noncompliance.
The board voted to grant the equitable waiver; the motion was made by Dave Davidson and seconded by Phil Howshan and recorded as unanimous. The approval includes the board’s standard condition that the granted relief expires if construction is not completed within two years and that compliance with the condition is required before a building permit is issued.
The notice of decision states the waiver was approved “for the reasons given” in the board’s resolution and repeats the two-year completion requirement and the statutory rehearing timeline for parties affected by the decision. No numeric fines or permit details were provided at the meeting.
The board’s action does not itself authorize a building permit; applicants must meet the listed conditions and local permitting requirements before construction begins. The town’s notice of decision references the New Hampshire statutory process for rehearing and appeal.
