Board approves partial release of covenant at 270 Sewick/Seward Neck Road with drainage condition

The Dennis Planning Board voted June 16 to grant a partial release of a covenant for a definitive open-space subdivision at 270 Sewick/Seward Neck Road (plan no. 254), releasing lots 1, 2 and 4 while retaining Lot 3 and requiring full installation and maintenance of the designed drainage before a building permit for Lot 2 is issued.
Rick Hamlin moved the motion, which included a condition that "all drainage as designed be installed prior to issuance of building permit for Lot 2 and that all drainage and mitigation efforts be maintained until such time as the project is released in its entirety." Members had raised visible erosion and runoff concerns on Lot 3 and emphasized the need for on-site containment and erosion control measures.
Paul told the board that the developer had built the road, installed culverts and a fire hydrant, and that engineering had reviewed and accepted those elements. Board members asked that compliance with the drainage design be explicitly enforced as part of the release; Hamlin's motion was seconded and carried by roll call with all members voting in favor.
The board discussed sequencing and enforcement: members said the developer should complete required drainage measures before construction proceeds on Lot 2 and that the town would maintain authority to withhold further releases until the full project is compliant.
