Code enforcement staff told the board the original citation included five violations — three unpermitted HVAC installations and two permits that had been started then abandoned — and that inspectors had opened 16 permits related to the matter. "As it stands right now, 12 of those permits [are] fully finaled," the staff presentation said, and only four permits still required action. Staff recommended a finding of substantial progress to allow the owners additional time to complete remaining work.
"We submit on the city's presentation," said Ryan Port, attorney for the appellants, indicating the appellants would not contest the city's factual update. A board member commented, "Seems like they're moving forward, so I'm fine," and moved that the board determine the appellants had made substantial progress toward correcting the outstanding violations.
The chair announced the motion was moved and seconded; the board voted to find substantial progress and continued the hearing to a later date to allow the remaining work to be completed. The motion noted the citation issued Dec. 17, 2025 and the board recorded that the matter will return as a continued hearing to verify final correction.
