Board accepts Department request to pursue rulemaking for Mpox and carbapenemase-producing organisms

The Washington State Board of Health on April 8 accepted a request from the State Health Officer to consider rulemaking that would add Mpox and carbapenemase-producing organisms (CPO) to the state’s list of notifiable conditions (chapter 246-101 WAC).
Board and Department staff explained the request grew from prior provisional reporting orders that are approaching their 40-month limit. Department staff said COVID-19-related rulemaking is already underway in a separate CR-101 filing, so the Board authorized staff to initiate the Mpox and CPO rulemaking once the COVID-19 rulemaking is complete. The motion was approved unanimously.
Assistant Attorney General Chris Gerard explained sequencing requirements and the Board’s authorization helps avoid duplicative filings while ensuring continued disease surveillance and reporting is considered for these conditions.
What happens next: Board staff will initiate rulemaking for Mpox and CPO reporting after the COVID-19-specific process concludes and will follow standard WAC procedures.
