Council hears request to reduce developer bond; staff says $717,000 would remain to secure public improvements

The council considered a staff recommendation to approve a reduced bond for a developer working on an amended land-development plan that includes reconstruction of Taco Bell Drive. Staff said the developer is seeking a reduction of the existing bond and that, based on engineer review, the balance remaining to be secured would be about $717,000.
Staff provided the council with background on the project, saying the developer received earlier land-development approval in 2021 and that a prior partial release occurred in 2024. "They're asking for a reduction of the bond for about 1.9," a staff speaker said, and added that the borough would require a new bond to cover the remaining public improvements, including roads, sidewalks, lights and storm sewer work.
The Planning Commission reviewed the application at its May 5 meeting and recommended amended land-development approval subject to a list of conditions, staff said. "Those conditions have been incorporated into the resolution before council this evening," staff added and then turned the presentation over to Julie Bernstein to address site-specific concerns.
Bernstein and other speakers focused on traffic mitigation and screening for the site. Presenters said the applicant returned multiple times to the Planning Commission to respond to traffic questions and to revise plans. Staff told council that the applicant found the listed conditions acceptable.

If the council approves the resolution as described, a reduced bond would be allowed and a new security amount (stated by staff as about $717,000) would be posted to guarantee completion of the remaining public improvements.
