The Jefferson County Board of Zoning Appeals voted to approve a setback variance for a small building site at 8484 State Road 56 after finding the request met the board’s required findings of fact.
At the start of the applicant’s presentation, the chair invited Jared to describe the request. “I just have a small piece of property at 8484 and State Road 56 and just a small section of flat ground that’s able to be a building site,” Jared said, asking to locate a new structure a little closer to the road than the standard setback to take advantage of the flat ground. He told the board that notified neighbors had returned the mailed notices ("green cards").
Board member Larry W said he visited the site and observed that neighboring houses sit closer to the road than the applicant proposes. The applicant added that an existing shed on the lot is closer to the road than the planned building and that the proposed placement would not block any neighbors.
A board official read the board’s findings of fact aloud, asking members to determine whether the record supported three standard findings: that approval would not be injurious to public health, safety, morals or general welfare; that adjacent property values would not be substantially affected; and that strict application of the ordinance would result in practical difficulties for use of the property. Board members answered in the affirmative.
A member moved to approve the variance; after a second, the board voted in favor. The chair told the applicant the signed application approvals and findings would be emailed to him. The applicant thanked the board and left the meeting.
The board also approved the minutes from its previous meeting earlier in the session and then voted to adjourn. No public commenters opposed the variance during the hearing.
The board’s decision authorizes the applicant to place the proposed structure closer to State Road 56 than normally allowed under the ordinance; the transcript records the procedural findings and the motion to approve but does not specify an ordinance number or exact setback distance. The board’s office will issue the signed approval to the applicant by email.
