The Waushara County Planning and Zoning Committee unanimously approved a zone change that will allow a roughly 6,000-square-foot market and deli to be built near Fairway View Lane.
The committee approved the rezoning application from Carey Holdings LLC (of Wauwatosa) after staff read a recommendation for approval with conditions. Ed Klinger, the applicant’s representative, told the committee the plan is to develop "a meat market/deli/small grocery store," add about 32 parking stalls and break ground this fall. He acknowledged standing water on the property and said a professional civil engineer will address stormwater handling.
Staff told the committee the parcel was previously proposed for a 44-unit multifamily development but only minimal construction occurred; KRB Holdings LLC purchased the property in 2022 and is now seeking to rezone several parcels (from AG, OP, and RM zoning to CS commercial service) to concentrate commercial development along State Route 201. Planning staff recommended approval subject to conditions intended to address runoff and construction impacts, and the Town of Dakota submitted a letter saying its town board had no objections.
Committee members read a set of conditions that must be met if the rezoning is implemented: substantial compliance with the approved site plan, adherence to required setbacks and codes, all required land-use and building permits, consolidation of parcels via certified survey maps as needed, vacation and redesign of the segment of Fairway View Lane to accommodate driveway and parking, and specific stormwater measures. Condition 5, read verbatim by staff, requires the applicant to contact the Department of Natural Resources about any stormwater requirements; if DNR approvals are not required, the developer’s engineer must meet with County Land Conservation personnel to verify on-site runoff is adequately handled.
The committee moved and seconded the measure and recorded the vote as unanimous; the motion carried. The approval is conditioned on the listed permits and plan changes, and the application will be forwarded to the appropriate town boards for their actions on CSM and township jurisdiction matters.
The committee did not record additional funding or implementation timelines beyond permitting steps; next steps for the applicant are to secure required permits and complete any DNR or county Land Conservation reviews called for in the conditions.
