District, association revise representational-activity language to comply with Idaho HB 516

The Caldwell negotiation session spent an extended block of time updating Article 7 of the master agreement to respond to House Bill 516 (Idaho), which restricts certain association privileges and requires districts to define permitted representational activities and procedures in their local agreements.
Legal counsel and staff (Stephanie and others) presented draft language adapted from Idaho School Boards Association guidance and examples from nearby districts. Core topics included permitted representational activities (as defined in Idaho code), how release time will be taken (accrued personal leave, unpaid leave, or reimbursed release where the association covers prorated compensation and substitute costs), scheduling and approval procedures for release time (requests submitted at least three work days in advance when practicable), and facility-use rules (the association will not receive preferential access or reduced fees beyond policy allowances).
The committee also debated definitions. Members clarified the difference between 'duty hours' (contracted hours established by the district) and 'duty status' (periods in which an employee is performing assigned duties; this may include some time outside of contracted hours). The group adjusted language on uninterrupted/continuous preparation time and considered how administrative direction and additional responsibilities will be captured.
The board moved, seconded and approved the Article 7 language tied to HB 516; the group left the relationship compact and CAPS (collaborative problem-solving team) language for a follow-up meeting so those items can be refined without privileging the association and while ensuring teachers can select representatives as required by law. Participants asked staff to produce a redline and to circulate the revised text before the next session.
