Council debates remote participation rules; leans toward limited 'just cause' allowance

City Attorney staff briefed the council on evolving rules for remote participation. Tim (city attorney) and Assistant City Attorney Dave Richie explained that current rule changes require that if a council member participates remotely, the city must also allow members of the public to attend the meeting remotely; that requirement complicates short-notice remote participation unless the city already provides remote public access.

Council members raised confidentiality concerns for closed sessions, the risk of undermining in-person deliberations, and the potential for abuse if remote attendance becomes routine. Councilman Reynolds recalled earlier experience during pandemic-era remote participation, noting it had proven difficult to reverse once broadly allowed. Several council members indicated support for allowing remote participation only for defined "just cause" reasons provided in statute (illness, caregiving, emergency, etc.) and for the city to return with a narrowly tailored policy.

Staff noted the alternative teleconferencing option that lists just-cause bases is currently available but set to expire Jan. 1, 2030, and that a longer-term approach would rely on standard teleconferencing rules. The council gave direction for staff to draft policy options that preserve confidentiality protections for closed session and set clear limits around frequency and acceptable reasons for remote participation.
