Milpitas council confirms 2026 weed abatement assessments; charges to become property liens

The Milpitas City Council on June 2 adopted a resolution confirming the 2026 weed abatement assessment report and directed that the assessment list be entered on the county tax rolls, city staff said.

City staff told the council the council previously declared weeds a public nuisance on March 3 and that staff contracted with the county to remove weeds on properties where the nuisance was not abated. Pursuant to the municipal code and the California Health and Safety Code, staff said a confirmed assessment list will be submitted to the county auditor on or before Aug. 10 and that the council’s recording of the resolution will place the related charges as liens on the affected parcels.

“We have followed the municipal code and the Health and Safety Code; following adoption by the city council, the resolution will be recorded and charges become a lien on the land involved and collected the same manner as property taxes,” the Deputy Fire Chief/Fire Marshal said during the presentation.

The council opened the public hearing on the assessment report but received no public comment. Councilmember Chua moved to adopt the resolution; the motion was seconded and the council approved it on a unanimous voice vote.

The resolution and assessment list will be recorded and forwarded to the county for placement on next tax assessment rolls, staff said. No additional implementation dates beyond the Aug. 10 submission deadline were provided at the meeting.

After the vote the council moved to general announcements and adjourned.
