Trustees voted to reject the single submitted bid for stair replacement at Mountain View Elementary, Flag View Intermediate and Spring Creek Elementary after district staff determined the bidder lacked the required contractor license classification.
District staff reported a sole bid from Element Construction for $191,563 but said the firm did not hold the necessary general contractor (C-1/C-5) license to perform the full scope. A trustee moved that the board find the district "legally received no bids" because Nevada Revised Statutes (NRS) 338.1475 prohibits accepting bids from improperly licensed contractors. The motion passed.
Legal counsel then recommended readvertising the project without competitive bids pursuant to NRS 338.143 because of timing constraints and the absence of a legally responsive bid. The board approved a motion to readvertise and authorized the superintendent to award the contract to the lowest responsive bidder after a seven-day advertisement, provided the award does not exceed the board's previously approved budget of $200,000.
The board and staff discussed outreach to local licensed contractors, timing to allow work to start before students return, and options such as reconfiguring work (for example, ramps versus stairs) but concluded ADA and engineering constraints made those alternatives impractical for these locations.
