The Finance & Personnel Committee approved the city developer agreement with VH Fezant Crossing LLC for Fezant Crossing Phase 2 at its May 19 meeting after staff and the developer clarified phase descriptions and answered member questions on payments and environmental protections.
Luke, an online developer representative, explained that references to phases three and four in the agreement refer to lands east of High Road, while the current Phase 2 covers lands south of Misty Valley and west of High Road. Members asked whether the additional $100,000 cash payment tied to phase timing had been received; staff said they would check and confirmed the fee structure for Phase 2 remains in the packet.
Committee members pressed for assurance that the city would enforce erosion-control provisions and mitigate dust given prior construction impacts; staff said the city would continue enforcing its ordinance and that dust-mitigation measures are available. Members also noted typographical errors in the packet (an incorrect mayoral name) and staff confirmed templates and names would be corrected.
The motion to approve the developer agreement carried; staff said the agreement is similar to Phase 1 except that it now addresses Phase 2 sequencing and fee timing, and that the city attorney had reviewed language.
