County approves amendment tightening milestones and repayment language for ABC Thompson LLC grant

The Grand County Commission on June 2 approved a first amendment to a grant agreement with ABC Thompson LLC refining milestones, tightening deadlines and adding repayment and clawback language.

County staff and the county attorney presented an amendment that requires submission of a site plan by July 15 and approval by Aug. 25, with business licensing, certificates of occupancy and an opening target by Dec. 31. The amendment also tightens default language so that missed milestones without an approved written extension become material defaults, trigger a 30‑day cure period and can lead to full repayment/clawback of funds.

Commissioners and staff said the amendment balances the county’s interest in ensuring deliverables while continuing to provide support and technical assistance: county planners are available to assist with site plan review and building‑department staff can help with permitting. The attorney noted the county would not proceed to litigation or collection without further commission direction; instead staff will report back on compliance and the commission will authorize enforcement steps if necessary.

The motion to approve the amendment passed with the vote recorded as 6–0 (one commissioner absent). The contract includes explicit remedies and a statement that the amendment represents a final extension of the agreement unless the commission authorizes further changes.

County staff said they will monitor the July–December milestone schedule and return to the commission with any requests for extensions or with evidence of default.
