Town Attorney Curts said the Town of Loxahatchee Groves council would move into an attorney–client conference to discuss strategy and a potential settlement in two pending lawsuits against the town. "There are two cases before you," Curts said, adding that the council had received a settlement offer that afternoon.
Curts told the council the closed conference would be recorded by a court reporter and "we will take down a verbatim transcript of our meeting. That transcript will not be available for public dissemination until the conclusion of these two pieces of litigation." He described the purpose as discussing strategy and potential settlement.
Before moving to the closed session, the council conducted routine opening business. A motion to approve the meeting agenda was made and seconded and, after a voice vote, was recorded as passing "4‑0." Later, a motion to adjourn the shade meeting was made, seconded and likewise recorded as passing "4‑0." The clerk noted that Council Member Coleman was en route and that another roll call could be taken if necessary.
The two lawsuits were identified in the meeting transcript as 444 B Road LLC v. the town and 556 B Road LLC v. the town; the transcript contains inconsistent spellings of the town name. The council moved to the conference room to continue the attorney–client session, with a court reporter present to create a confidential verbatim record that the town said would remain sealed until the litigation concludes.
No further public detail about the substance of the lawsuits, the amount or terms of the settlement offer, or any votes on settlement were discussed on the public record in this transcript. The council proceeded into the closed conference as announced by the town attorney.
