Board of Appeals grants Capitol Heights homeowner variance for driveway extension

The Prince George's County Board of Appeals voted 3–0 May 6 to approve a variance allowing a driveway extension at 1309 Nome Street in Capitol Heights for petitioner Kenya Guadalupe Cardenas Rivera.
Chair Boulware said the board found the property’s “extreme narrowness and shallowness and sloping to the right” met the criteria in Council Bill CB-16-2021 (zoning ordinance §27‑36‑13) and allowed the relief requested. "I do find that you've met all the conditions for us to grant you a variance," the chair said.
Kenya Cardenas, who testified with the aid of an interpreter, said the driveway work was done to address an existing safety issue and water pooling. Prince George's County inspector Swan confirmed there was an application in DPIE’s system for the driveway work.
Vice Chair Johnson moved approval, Member Stanton seconded, and the board administrator recorded a 3–0 roll-call vote in favor. The board instructed the petitioner to follow up with staff on next steps and to present the board's written order when applying for permits.
The variance validated existing conditions and allows the petitioner to obtain county permits to legalize the driveway extension. The petitioner was excused after the vote.
The board noted that approval of a variance does not remove the need for subsequent permitting or review by other county agencies.
