Summary
The Board approved a one-year extension to June 2027 for Mahwah Business Park LLC’s June 19, 2024 conditional use variance and site-plan approval because the applicant’s NJDEP A-901 application remains pending; the vote was 4–0 among members present.

The Township of Mahwah Board of Adjustment voted to grant a one-year extension of the conditional use variance and site-plan approval for Mahwah Business Park LLC, extending the approvals from the June 19, 2024 expiration to June 2027.
Attorney Andrew Kohut, representing Mahwah Business Park LLC, told the board the applicant had not yet received all required approvals from the New Jersey Department of Environmental Protection and that the A-901 application — a key NJDEP approval — was still being processed. Board counsel John Conte said the board may grant a one-year extension but noted state and local practice limit the board to approving only one year at a time; the applicant must return if additional time is needed.
Board member Mr. Sitar asked whether notice to surrounding property owners was required for the extension; Mr. Conte replied that notice was not required for this extension request. There were no members of the public who commented on the application during the public comment period.
A motion to approve the extension was made by Mr. Taylor and seconded by Mr. Lockwood. A roll call vote recorded ayes from Mr. Lockwood, Mr. Sitar, Mr. Taylor and Mr. Cannava (4 ayes); the motion carried. The applicant’s approvals are now extended through June 2027; if more time is required the applicant must reappear before the board to request a further extension.
