Fall River council presses for dedicated outside counsel; corporation counsel objects

Supporters said the council needs independent access to prompt legal guidance, pointing to recent disputes over appointment confirmations and the council’s investigative authority.
Corporation Counsel Marcus Rumsey opposed the idea. He told councilors that having multiple retained legal voices risks inconsistent legal positions and could increase overall costs; he said the law department is prepared to provide counsel to the council and cautioned that outside retention can prompt market‑rate increases. The exchange became heated at times as councilors and counsel disagreed sharply on process and precedent.
Outcome: Rather than immediately create a council legal line, the council voted 6–3 to send a letter to the mayor requesting the mayor include a $40,000 appropriation in the city‑council FY27 budget for outside legal counsel. The clerk will deliver the request to the mayor to consider in supplemental materials.
What’s next: The mayor can choose to propose the $40,000 appropriation; if included in the mayor’s recommended budget the council will consider the appropriation as part of the FY27 process. Corporation Counsel said he will continue to provide legal services to the council in the interim.
