Colts Neck Township Committee moves into executive session to discuss potential litigation

The Colts Neck Township Committee voted on April 27 to enter an executive session to discuss potential litigation, according to a committee resolution read at the special meeting. Four of the five committee members were present; Committeeman Rizzuto was recorded as absent.

The committee’s Resolution 2026-76 cited the New Jersey Open Public Meetings Act and its closed-session exception for anticipated litigation. The resolution states, “The Committee will not be taking any action during closed executive session,” and notes, “It is anticipated that the closed session will last approximately 90 minutes.”

Before the executive session, the Township Clerk confirmed that notice requirements of the New Jersey Public Meetings Law were met by publication in the Asbury Park Press and the Two River Times on April 23, 2026, and gave the meeting details (April 27, 2026, 4:00 p.m., Town Hall, One Veterans Way). The clerk then called roll: Committeeman Tubito, Committeewoman Buss, Deputy Mayor Buzzetta and Mayor Viola were recorded present; Committeeman Rizzuto was noted absent.

Committee members moved to open a public-comment period and, seeing no speakers, immediately moved to close it. The resolution to enter executive session was then offered, moved and seconded; members indicated assent by voice vote. Meeting staff closed the livestream and the committee adjourned the public portion and entered executive session.

The resolution said the subject of the closed meeting will be made public when confidentiality no longer exists. The committee did not take any other formal public actions at the special meeting.
