The Select Board on Aug. 12 approved an outdoor entertainment license for 776 Main Wine Bar LLC, operating as Baleen, allowing limited outdoor seating and modest acoustic entertainment subject to conditions intended to limit sound disturbance to nearby residents.
Attorney Anthony Panabianco, representing the proprietors Adam and Erica Dunn, told the board the request continues prior outdoor seating activity and that the Zoning Board of Appeals (ZBA) had imposed conditions to address neighbor noise concerns. Several abutters urged the licensing authority to limit outdoor entertainment to 10 p.m.; one resident said she would "encourage you, especially given the town of Dennis Noise ordinance, that you do not allow outdoor entertainment on that patio past 10PM." Counsel and applicants said the intent was to comply with the ZBA and community input and that the 1AM reference in ZBA paperwork was likely a typo.
The Select Board adopted conditions consistent with the ZBA decision: no outdoor dining service, music or other noise audible off premises after 10 p.m.; every effort to keep outdoor dining noise off the Dennis Commons property during service hours; acoustic solo or duo performance without amplification limited to 3–8 p.m.; and low-volume ambient music through perimeter speakers when acoustic performers are not playing, subject to the noise limitations.
The motion to approve the outdoor entertainment license (hours 10 a.m.–10 p.m. on weekdays and Sundays) passed unanimously. The board noted it will review the license annually and urged monitoring of noise complaints to ensure compliance.
