Colts Neck Committee moves into closed executive session to discuss potential litigation

The Colts Neck Township Committee convened a special meeting April 20, 2026, at Town Hall, One Veterans Way, and approved a motion to enter a closed executive session to discuss potential litigation, officials said.

The clerk read a notice under the New Jersey Public Meetings Law and the language of the committee's resolution, including that “the public shall be excluded from discussion of any action upon hereafter specified subject matter,” and that the session concerned “potential litigation, confidential pursuant to N.J.S.A. 10:4-12b7.” The resolution was introduced as Resolution 2026-75 and made effective immediately.

Committee members conducted a roll call before the motion. Mr. Tobia and Ms. Boss answered present; Mr. Rizzuto was noted as joining remotely; Deputy Mayor Bizzeta and Mayor Viola were present and the mayor announced a quorum. The committee opened the meeting for public comment, received no speakers, and closed public comment by unanimous voice vote.

A motion to go into executive session was then moved and seconded and approved by voice vote. Committee members informed those present that they would not be returning to public session that evening and that the closed session was expected to last approximately 90 minutes. The resolution states the committee will not take action during the closed session and that matters will be made public when confidentiality is no longer required.

No additional details about the subject of the potential litigation were disclosed at the public meeting. The clerk noted a copy of the meeting notice is on file in the office of the Township Clerk. The committee left for the closed session following the vote.
