City attorney tells Deltona commission staff will likely recommend joining multi-district antitrust litigation over fire apparatus manufacturers

The Deltona city attorney told the commission on June 1 that the city has been researching pending antitrust litigation involving major fire apparatus manufacturers and is likely to recommend Deltona join a multi-district lawsuit.

The attorney summarized the complaint as alleging that certain manufacturers conspired to restrain trade and commerce through price fixing, production suppression, market manipulation and exchange of confidential information for the period from 2016 to the present. The city attorney named the defendants cited in the operative multi-district litigation as REV Group, Oshkosh Corporation and Rosenbauer America and said the federal court in Wisconsin approved the multi-district litigation on April 3, 2026.

The attorney said the city has shared available purchase information with lead counsel and is assessing what purchases are eligible for recovery; staff expects to recommend joining the multi-district litigation and indicated a formal request to participate is likely to appear before the commission in roughly a month. When commissioners asked how many of Deltona’s apparatus purchases might be eligible, staff said they were still identifying eligible purchases but expected two or three larger purchases would likely be included.

No formal commission action to join the litigation appears in the meeting record; the attorney said staff will return with a formal recommendation and document list for the commission to consider.
