Commission tightens adult‑entertainment rules, increases spacing and limits hours

The commission adopted amendments to Article 8 of the land development code on May 19 that revise rules for adult‑entertainment uses in the Transit Supported Development District.
City attorneys explained changes since first reading: the required supermajority threshold was clarified (a four‑fifths vote is only needed for new high traffic intensity uses, not for this amendment), hours of operation were limited to 3:30 p.m. to 5:00 a.m., and the draft now references section 4‑6(b) for alcohol service rules rather than a blanket chapter reference. The ordinance increases minimum spacing between similar uses to 1,000 feet and limits site plan approval review by the commission to confirming compliance with applicable code sections, including parking, site access, paint/color, signage orientation and lighting.
Questions from commissioners focused on signage review authority and whether Design Review Board (DRB) or the commission would retain final review for specific signage when not included in the original application. City attorneys clarified that signage included in a site application would be reviewed as part of site plan/DRB submittals but separate sign permits might not automatically return to DRB unless a variance or other special approval is required.
After public comment was closed (no speakers), the commission voted on second reading and adopted the ordinance 4–1.
