Manor holds public hearing on rezoning two parcels from Open Space to R‑1

Manor Borough Council held a public hearing May 14, 2025, in the Manor Community Room to consider an ordinance amending the borough zoning map to reclassify parcel nos. 19-01-06-0-002 and 19-01-06-0-003 from Open Space (OS) to Residential (R-1). Council President Tony Gockel called the hearing to order at 6:03 p.m.
Solicitor Chelsea Dice opened the record by describing the purpose of the hearing and asking the property owners to make their case. Attorney Anthony Posa, representing the owners, said the land "was originally residential then changed to open space" and asked the borough to return the parcels to residential zoning. Dice entered into the record proofs of publication (Westmoreland Law Journal and Penn Trafford News) and affidavits from the borough manager that the county planning department had been notified, the property posted, and adjacent owners notified.
During a brief exchange about whether the requested rezoning would constitute spot zoning, Council President Tony Gockel asked for clarification. Solicitor Dice responded that it was not spot zoning "because the adjacent properties are zoned residential." Councilman Chuck Charrie further discussed spot-zoning concerns, and Dice and council members discussed subdividing the property because of a stormwater retention pond located at the back of the parcels.
No vote on the ordinance was recorded during the hearing. Councilman Dave Gongaware moved to close the public hearing and adjourn; Jim Vacha seconded. The motion was recorded as "carried unanimously," and the hearing adjourned at 6:18 p.m. The hearing record lists Joseph N. Lapia as Borough Manager.
