Clallam County commissioners met in an executive session May 20 to receive updates from the county prosecuting attorney about potential litigation, District 1 Commissioner Mark Hosias said. The board cited RCW 42.30.110 as the legal basis for the closed discussion.
"We are here for an executive session with the prosecuting attorney's office, under RCW 42.30.110," Commissioner Mark Hosias said when the meeting was called to order and the recording began. After a roll call and brief introductions, the board moved into the closed session.
Bonnie Dindler, director for human resources and risk management, proposed the initial length of the closed session: "I would say an hour," she said before making a motion to move into executive session for one hour. The motion was seconded and the chair paused the public recording; commissioners returned to the record at 10:02 a.m.
After the first hour, Hosias said additional discussion with legal counsel was needed and announced a 30-minute extension. "If there is no objection, we are going to move back into executive session for an additional 30 minutes," he said; the chair recorded no objections and the meeting continued in closed session.
The chair noted a few attendance changes during the closed discussions: Judge Newport and Marissa Williams from District Court 1 exited the meeting when the board briefly returned to the record at 10:02 a.m., and Commissioner Mike French left the executive session at 10:10 a.m. Hosias summarized the closed-session exchanges as updates from legal counsel on a number of potential litigation matters and told commissioners the updates were informational.
"No action will be required or necessary at the conclusion of these updates," Hosias said when the board returned to the record at about 10:32 a.m. The meeting adjourned at 10:33 a.m.
The county did not record or announce any formal votes, decisions, or directives resulting from the closed session on the public record. The statutory basis cited for the closed session, RCW 42.30.110, authorizes deliberation with legal counsel on litigation and related enforcement matters, which is why the discussion was held in private under state law.
