Court of Appeals reinstates Planning Board approvals for Glen Wild (Avon Park) project

Town Attorney Michael B. Mednick reported to the Town Board on May 5 that the New York State Court of Appeals reversed the Appellate Division and reinstated the original Supreme Court decision in the matter of Chester Smith, et al. v. Town of Thompson Planning Board et al. The result, Mednick said, is that Planning Board approvals for the Glen Wild Land Company, LLC (Avon Park Project) have been reinstated.
Mednick provided a copy of the Court of Appeals decision for reference. The board did not take any immediate action; the report was presented for the record and to inform planning and next steps.
