One council member objected to the ordinance’s definition of “temporary” — specifically the limit of two 30‑day calendar periods in a year — saying that longer remodels and some projects may require more flexibility: “I think it’s overly restrictive still with the 2 30 day calendar periods in any calendar year,” the council member said. Finance Director Jason Faulkner told the council that when projects extend beyond temporary thresholds the city’s franchisee can provide larger roll‑off containers and that the franchise agreement provides revenue and program benefits to the city.
Staff said the two 30‑day periods were chosen to keep the exception narrow, to rely on complaint-based enforcement rather than constant monitoring, and to encourage longer projects to contract with the franchise provider. The council discussed revisiting the rule and staff agreed to track occurrences and report back if adjustments are needed. The ordinance was placed on its first and only reading and approved by roll call (one recorded 'nay'); the motion passed.
