Council recommends Land Use Authority allow Topaz Townhomes preliminary plat to proceed with conditions

The Hinckley Town Council on May 21 reviewed the preliminary plat for the Topaz Townhomes subdivision and agreed to recommend that the Hinckley Land Use Authority allow the development to proceed, provided Apex Development Partners, LLC resolves remaining checklist items before final plat recording.
Greg Hardman, attorney for Apex Development, told the council that the Planning Commission had already approved the preliminary plat contingent on validating town water and sewer capacity; James Saunders of Jones & DeMille Engineering certified capacity on May 8. Hardman said some deficiencies listed in the town engineer’s most recent checklist reflected a new ordinance adopted April 23, 2026, rather than the code in effect when Apex submitted its initial application.
Council members accepted the Planning Commission’s determinations on pavement widths and sidewalks. Hardman committed that Apex would address the outstanding items — including street signs, concrete manhole collars, and modifying the Public Utility Easement (PUE) so portions serving developed parcels are included rather than placed on a separate parcel — prior to final plat recording.
Council Member Ron Black voiced support for the developer’s commitments, and the council consensus was to forward a formal recommendation to the Land Use Authority allowing the application to move forward with final compliance verified before recording.
Next steps: The council’s recommendation will be transmitted to the Land Use Authority for its review. The developer must complete the listed corrections and provide verification of compliance (engineer/inspector sign-offs) before the town will record the final plat.
