Buffalo County approves vacation, rezoning and preliminary plat for Golfside Estates parcel

The Buffalo County Board of Commissioners on May 26 approved three connected land-use actions for a tract previously part of Golfside Estates.
During a public hearing led by Zoning Administrator Dennise Daniels, surveyor Joshua Gilbertson, representing property owner Scott R. Phillips and others, presented applications to vacate lots, amend the zoning map and file a preliminary subdivision plat. The Board voted in favor of Resolution 2026-22 to vacate Lots 23–24 and 26–31 and then adopted Resolution 2026-23 to rezone roughly 4.29 acres from Agriculture (AG) to Agricultural–Residential 1 (AGR-1). The Board also approved Resolution 2026-24 granting preliminary plat approval for what the applicant described as "Golfside #5 Subdivision." All motions passed on roll call among members present (Klein, Kouba, Lynch, Maendele and Morrow); Commissioners Higgins and Loeffelholz were absent.
The Board noted the Buffalo County Planning & Zoning Commission had recommended approval on April 16, 2026, and the record references prior relaxations granted by the Buffalo County Board of Adjustment for subdivision standards (including road/access and lot-size-related provisions) that affect the proposed plat. The resolution and supporting materials specify that the vacated tract contains about 4.29 acres (187,156.92 square feet) and that no public utilities occupy the land sought to be vacated.
The Board’s action authorizes the County Clerk to file the resolutions so the vacation and zoning map amendments are recorded. The preliminary plat approval is explicitly not a final plat approval; the resolution states that no copy of the resolution should be filed to affect title until a final plat is approved.
