Planning board classifies 160 Old Tarrytown wetland permit as Type II and turns decision over to wetlands inspector

The Greenburgh Planning Board on April 2 voted to classify PB2504 (160 Old Tarrytown Road) as a SEQR Type II action and to turn the minor-project wetland/watercourse permit over to the town wetlands inspector for decision under Town Code §280-8(b)(1).

Project details and staff recommendation: Britton (presenter) described the project as a deck expansion with an integrated hot tub that adds about 7 square feet of impervious coverage; the rear yard work lies nearly entirely within the 100-foot buffer to an off-site watercourse that runs through the adjacent Camp Mohawk property. Britton said the conservation advisory council recommended approval. Staff recommended the board consider the Type II classification under SEQR and, if satisfied, waive full planning-board jurisdiction and permit the wetlands inspector to issue the minor-project permit with standard protective conditions such as construction fencing and erosion controls.

Safety and code notes: A staff member (speaker 6) noted that New York State in November 2022 allowed a safety cover for hot tubs in lieu of a barrier, following the International Swimming Pool and Spa Code standard, and that the building department can enforce the cover requirement. The contractor, Brian, confirmed the hot tub will be covered: "It's gonna be covered," he said.

Motions and outcome: The board voted first to classify the project as a Type II action under SEQR, then voted to waive jurisdiction and turn the matter over to the town wetlands inspector; both motions passed. Staff said the wetlands inspector will issue a decision consistent with the inspector’s report and the conditions discussed.
