The Town Board on May 27 approved Resolution #103 to settle assessment challenges filed by the City of Elmira concerning the Mark Twain Golf Course.
Town Attorney John P. Mustico and Town Assessor Teresa Lyons reported that Elmira filed challenges to the 2022, 2023 and 2026 assessment rolls. As part of the negotiated settlement, the City agreed to withdraw its 2022 and 2023 requests for reductions with no refunds or retroactive adjustments owed by the Town. The board established a full market value of $1,150,000 for 2026 and fixed that valuation for 2027 and 2028, absent physical changes or other statutory grounds for adjustment.
Resolution #103 authorizes the Town Assessor to make entries necessary to implement the settlement and authorizes the Town Supervisor, Town Attorney and Town Assessor to execute stipulations or settlement documents. The resolution passed unanimously.
Board members said the settlement provides valuation stability and avoids the cost and uncertainty of continued litigation. The minutes state the board found the settlement fair, reasonable and fiscally prudent.
