Caleb Hood, community development staff, explained staff’s decision that the tenant application did not meet the city’s numeric definition of “flex space” (which requires a minimum proportion of warehousing/manufacturing vs. office in the IL zone) and therefore required a certificate of zoning verification change of use. Applicant counsel Jeff Wardle argued the building has historically contained office uses, pointed to a 2020 tenant improvement and occupancy history (including a state lease for vocational rehabilitation), and alleged inconsistent enforcement and application of the code across similar sites. Wardle asked council to direct staff to approve the applicant’s CCC/recognize the space as flex space or as an accessory professional office.
Council members debated predictability, precedent and whether past approvals had been handled consistently; several members said the code needs refinement but expressed sympathy for an owner who had relied on earlier approvals. Councilman Taylor moved to overturn the director’s denial and grant the appeal; the motion carried on a roll call of ayes.
