Lincoln County planning staff recommended, and commissioners voted, to deny a Kaufman family‑transfer exemption at the April 8 meeting after reviewing the chain of title and recent transactions.
Planning staff told commissioners the parcel history includes a 2000 subdivision, a recent boundary-line adjustment that enlarged the parcel to nearly 15 acres, and at least one quitclaim deed executed less than 12 months earlier. Staff noted the applicants are builders and developers and said those facts create a rebuttable presumption under county regulations that weighs against the family‑transfer exemption. Planning recommended that the owners instead proceed through standard subdivision review, which includes sanitation/DEQ review and would not impose the two‑year sale restriction that sometimes accompanies family‑transfer exemptions.
An applicant representative explained that part of the property was intended for the children and that earlier boundary work was done to accommodate family needs; commissioners discussed road layout, sanitation review, and long‑term consequences of bisected parcels. The board accepted planning’s recommendation to deny the family‑transfer exemption; the applicants may apply for subdivision review if they wish to proceed with parceling the property.
