Board of Zoning Appeals approves setback variance for property at 8484 on State Road 56

The Board of Zoning Appeals voted to approve a setback variance for a small parcel described in testimony as "8484 and State Road 56," allowing a proposed building to be placed closer to the road than current setback rules normally permit.

Jared, the property owner, told the board the site includes "a small section of flat ground that's able to be a building site" and that he was "just asking for that variance to come a little closer to the road," adding that mailed notices (green cards) had been provided. "It's not going to block any neighbors," he said.

Board members discussed site context and said neighboring houses are in several cases closer to the road than the applicant's proposed building location; a member also noted an existing small shed on the parcel that would be nearer the road than the new construction. The board then read the standard findings of fact for a variance, stating that approval would not be injurious to public health, safety, morals or general welfare; that adjacent property values would not be substantially adversely affected; and that strict application of the ordinance would create practical difficulties. Members answered those findings in the affirmative.

A member moved to approve the variance; the motion was seconded and the board voted in favor. The board informed the applicant that staff would email the signed application approvals and findings.

The board handled the item with minimal public comment and closed the matter without conditions recorded in the transcript. The meeting then continued to other business and was adjourned.
