Lewistown approves consultant contract to update zoning code using grant funds

The City of Lewistown City Commission approved a motion to contract with Cushing Terrell to assist in revising the city's zoning code and related documents.

City Manager Holly Phelps said the Montana League of Cities and Towns, in partnership with the Department of Commerce, helped secure a grant to implement provisions of the Montana Land Use Planning Act; the city was allocated about $158,000 for plan and code work. "We received two proposals and both scored highly," Phelps said. Staff recommended proceeding with Cushing Terrell on a phased, not‑to‑exceed contract for the work outlined in the RFP. She said the initial phase budget is under $50,000, with later phases to be brought forward as needed.

Commissioners asked about procurement thresholds and whether the contract should include a dollar cap in the motion. Phelps summarized the city's purchasing policy: department heads have limited discretionary authority for small purchases, written quotes are required in mid‑ranges and purchases above the city threshold come to the commission; state law requires formal bidding at $100,000 (the city's bidding threshold is slightly lower).

The motion to approve Cushing Terrell and authorize the city manager to sign the agreement was made by Commissioner Mueller, seconded by Commissioner Bowser, and approved by roll call.

Next steps include finalizing the contract scope and schedule, conducting public engagement as part of code updates, and returning to the commission for any phases that exceed the commission's purchasing thresholds.
